The following are the terms and conditions of The Water Monopoly (2003) Limited. (Hereinafter “the Sellers”); all quotations and orders are made and accepted only upon these conditions unless expressly varied in writing by the Sellers, no modification variation or amendment of these conditions by the Buyer whether in writing or otherwise shall have any effect. Unless otherwise stated or previously withdrawn every quotation is open for acceptance within thirty days only from its date. All prices are quoted in GBP (£). All transactions must be completed in GBP (£). Due to fluctuations in exchange rates, any prices quoted in USD ($) or EUR (€) are for information only and therefore may differ from a final transaction. VAT will be charged at the current British VAT rate on all orders placed within Great Britain and the European Union. Sales tax will not be charged for any other overseas order; however import duties may be imposed for which the Buyer is responsible. The Sellers are in no way responsible for any overseas duty or importation tax. A deposit of 50% of the total cost of the order is required with written confirmation of the order. The deposit is due for payment within seven days of the date of the pro-forma invoice. Payment guarantees the quoted price and reserves any antique piece. Antique items are returned to stock after the expiry of the seven day period. Payment is required in full at time of order for all reproduction accessories and fittings. No refund or exchange permitted on reproduction accessories and fittings unless faulty. Measurements provided by the Buyer for shower enclosures / doors are done so entirely at the Buyers own risk. Failure to provide confirmation of finishes / fitting information may result in your order being delayed. As confirmation times vary from product to product guides will be provided at the time of order. Contact will be made two weeks prior to completion of order to advise of the anticipated delivery date and the balance of payment due. A pro-forma invoice will be raised that is due for payment within seven days. On receipt of the balance of payment a completion date will be allocated. Delivery will be made only on the receipt of cleared funds (credit card facility available). A single delivery (one man and van) is free within the M25; charges for deliveries outside this area are available on request. Please ensure that there are at least three men on site to help offload the goods. It is the Buyers responsibility to inform the Seller of any logistical difficulties that may be anticipated during delivery. Our driver will, provided there is sufficient manpower; assist in the placement of goods in the Buyers designated room. It is the Buyers responsibility to fully inspect the goods on receipt and inform the Seller within forty eight hours of any damage. The Seller accepts no liability for damage reported after this time. Crating and shipping may be arranged for overseas sales on request and at the Buyer’s expense. The Seller accepts no responsibility for the faulty installation of the sanitary ware. These standard Conditions of Sale shall be operated and be constructed in conformity with the Laws of England. Any dispute arising there under shall be settled by arbitration in London in accordance with the provisions of the Arbitrations Act 1950 or any statutory modification thereof for the time being in force, each party appointing an arbitrator, unless a single arbitrator can be agreed upon. |
